Yesterday, the Ohio Supreme Court heard arguments about the unconstitutionality of local Predatory Lending ordinances.  Attached is a news report.

American Financial Services v. Cleveland, Case nos. 2005-0160 and 2005-0161

The City's argument that the legislature must pass a law permitting certain activity as the only way to pre-empt a local prohibition simply is incorrect as a matter of Ohio law precedent.  We will look for a decision after about six months.
